Florida Abortion Law

Abortion is legal in Florida, with certain restrictions. Florida law generally allows abortion up to six weeks of pregnancy, with limited exceptions after six weeks. State law also includes specific requirements for informed consent and requires medication abortion to be provided in person by a physician

Abortion in Florida

Abortion is legal up to 6 weeks gestational age with the following criteria met:

  • The patient receives abortion counseling at a doctor’s office and waits 24 hours after an initial visit before returning to undergo the procedure or receive an abortion pill prescription.
  • The patient receives an ultrasound before obtaining an abortion.

There are exceptions for the following circumstances:

  • The 6-week law provides exceptions for cases of rape, incest, and human sex trafficking; additional exceptions include allowing abortion to save the life and health of the mother and for fatal fetal anomalies.
  • Laws can change. Review the current Florida Statutes, Chapter 390, or speak with a qualified attorney or medical professional for guidance.
